These Terms of Use govern access to and use of the website angelsdeluxe.com (hereinafter, “AngelsDeluxe” or the “Website”), owned by [[RAZÓN SOCIAL]], whose full identifying details appear in the Legal Notice.

Together with the Legal Notice and the Privacy Policy, they constitute the entire agreement between AngelsDeluxe and the user. Please read them carefully: by registering or publishing an advertisement you confirm that you have read them and that you accept them in their entirety.

1. Definitions

• Advertiser: a natural person of legal age who creates an account and publishes one or more profiles on the Website in order to make known and promote the professional activity they carry out on their own account. The Advertiser contracts AngelsDeluxe’s services within the framework of their business or professional activity, and not as a consumer.
• Visitor: any person who accesses the Website to view profiles, with or without a registered account.
• Profile or advertisement: the set of texts, photographs, videos and contact details published by an Advertiser.
• Content: any material uploaded to the Website by an Advertiser.

2. Purpose of the service

AngelsDeluxe is a directory of contact and companionship advertisements for adults. Its function is exclusively one of advertising and technical intermediation: it provides a space in which Advertisers publish their profile and contact details, and where Visitors can find them and contact them directly.

AngelsDeluxe is not a party to any relationship established between an Advertiser and a Visitor, does not take part in their communications, neither provides nor intermediates in any activity carried out by the Advertiser on their own account, and receives no sum whatsoever arising from those relationships. The only amounts charged by AngelsDeluxe are those corresponding to the visibility services described in clause 9.

3. Content policy: what may and may not be published

3.1. Interpretation of the terms used

This clause is essential and prevails over any other interpretation of these Terms.

Where the Website uses terms such as “companionship”, “companion”, “contact”, “date”, “massage” or any other analogous term, they shall be understood solely and exclusively to refer to companionship services of a social, non-sexual nature: accompaniment to social or professional events, conversation, presence, leisure and equivalent activities.

Under no circumstances may they be interpreted as referring to the provision, offering, solicitation, promotion or intermediation of sexual services.

3.2. Absolute prohibition on content of a sexual nature

It is strictly prohibited to publish on AngelsDeluxe any content — text, photograph, video, emoji, code, abbreviation or any other means — that:

• Offers, solicits, promotes, insinuates or facilitates services of a sexual nature in exchange for financial consideration or any other benefit.
• Refers to prostitution, to its intermediation, to its promotion, or to the recruitment of persons for it.
• Describes, lists, prices or alludes to sexual practices, whether or not in explicit language.
• Shows genitals, bare breasts, sexual acts, masturbation or poses that simulate or suggest sexual activity.
• Uses coded language, acronyms, symbols, emojis or any other device intended to circumvent this prohibition or the moderation systems.

This prohibition admits of no exceptions and applies equally to the title, the description, the photographs, the videos and any other element of the profile.

3.3. Other prohibited content

Nor is content permitted, by way of example and without limitation, that:

• Involves minors in any context, or adults presented as minors.
• Promotes, conceals, insinuates or facilitates human trafficking, sexual exploitation, procuring, or any form of slavery or coercion.
• Depicts violence or degrading, humiliating or non-consensual acts.
• Incites hatred or discrimination on grounds of sex, gender, sexual orientation or identity, race, origin, nationality, religion, age, disability, illness or any other personal circumstance.
• Alludes to illegal drugs, non-prescribed substances, weapons or any unlawful activity.
• Includes bestiality, incest, necrophilia or any illegal practice.
• Contains photographs or videos that do not correspond to the person advertised, that have been manipulated, that belong to third parties, that carry another party’s watermarks, or that are screenshots.
• Shows other people without their express consent.
• Publishes the personal data of third parties (telephone numbers, addresses, documents, images) without their authorisation.
• Includes telephone numbers other than the one verified on the account, or numbers embedded within the images.
• Contains advertising, links or mentions of other advertisement portals.
• Consists of repeated keywords, illegible text or meaningless filler used to reach a minimum character count.
• Is fraudulent, defamatory, misleading or threatening.

3.4. Free and independent activity: prohibition of third-party control

AngelsDeluxe is an advertising space for adults who carry out their activity freely, voluntarily and independently, on their own account.

Consistently with this, the following is prohibited:

• Publishing an advertisement on behalf of another person, or managing a third party’s profile, save with the express written authorisation of AngelsDeluxe.
• Publication by agencies, intermediaries, representatives or unauthorised third parties who control, direct or condition the activity of the person advertised.
• Any form of coercion, pressure, retention of documentation, control over the communications or earnings of the person advertised, or unlawful profit at the expense of their activity.
• The recruitment, transfer or harbouring of persons for the purposes of exploitation, in any of its forms.

Where there is any indication that a profile does not correspond to a free and independent activity — including, among others, the appearance of the same telephone number, means of payment or device associated with multiple profiles of different people — AngelsDeluxe may suspend the profiles concerned, require clarification and, where appropriate, report the facts to the competent authorities in accordance with clause 10.6.

3.5. Consequences of breach

Content that infringes this policy will be rejected during prior moderation or removed once published. Depending on the seriousness of the breach and whether it is repeated, AngelsDeluxe may also suspend or cancel the Advertiser’s account in accordance with clause 11.

Deliberate attempts to circumvent moderation — coded language, re-editing rejected content, republishing after a removal — are treated as a serious infringement and may result in the immediate blocking of the account.

4. Access to the Website and age of majority

Access to the Website is strictly restricted to persons over the age of 18. Before accessing the content, every visitor must expressly confirm that they are of legal age.

By registering or publishing an advertisement you declare and warrant that:

• You are over 18 years of age and have legal capacity to accept these Terms.
• You act on your own initiative, freely and without pressure, coercion or third-party intermediation.
• All persons appearing in the images and videos you publish are of legal age and have expressly consented to their publication.
• You publish your advertisement and contract AngelsDeluxe’s services in the exercise of your business or professional activity, on your own account and for the purpose of promoting it, and not in the capacity of a consumer.

This last declaration is significant: it determines the legal regime applicable to the relationship between the Advertiser and AngelsDeluxe, in particular as regards the contracting of visibility services (clause 9). The Advertiser is responsible for complying with the tax, employment and administrative obligations arising from their activity, and AngelsDeluxe neither intervenes in nor supervises that compliance.

AngelsDeluxe may at any time require documentary evidence of age and identity, even where the profile has already been approved. A refusal to provide it entitles AngelsDeluxe to withdraw the profile or cancel the account, with no right to a refund of the services contracted.

5. Registration and user account

In order to publish an advertisement it is necessary to create an account by providing a valid email address and a password. The address must be confirmed by means of the verification link sent on registration.

The user undertakes to:

• Provide truthful, accurate and up-to-date information, and keep it current.
• Safeguard their password diligently, not disclose it to third parties and not allow others to access their account.
• Immediately notify info@angelsdeluxe.com of any unauthorised use of their account or any security incident.

The user is responsible for all activity carried out from their account. Until an incident is reported, AngelsDeluxe is released from liability for the improper use of their credentials.

The user may delete their account at any time from their dashboard or by requesting it at info@angelsdeluxe.com.

6. Publication of advertisements

6.1. Process

The Advertiser completes the publication form, stating among other things the category, title, description, location, profile attributes and a contact telephone number, and attaches the advertisement’s photographs.

Every advertisement is reviewed manually by the moderation team before it is made public. No profile, photograph or video is published without prior approval.

6.2. Telephone verification

The published telephone number must be a real, working number belonging to the Advertiser. To ensure this, AngelsDeluxe requires verification of the number by means of a one-time code sent by SMS.

Until the number is verified, the advertisement remains unpublished and visible only to its owner, who may freely edit or delete it. Once verified, it enters the moderation queue.

The same telephone number may not be associated with several active advertisements at the same time. AngelsDeluxe may limit the number of verification attempts and temporarily block this function in the event of abusive use.

6.3. Photographs and videos

Each advertisement accepts a maximum number of photographs, indicated on the publication form itself. The images must correspond to the person advertised, be recent, be their own, and comply with the content policy in clause 3.

Video may optionally be added, subject to the maximum duration and number of clips corresponding to the plan contracted. Every video is reviewed manually before publication and the Advertiser is notified of the outcome. The target review time is 24 hours, usually the same day.

6.4. The “Verified” badge

Advertisers who wish to do so may request the “Verified” badge by sending a verification photograph. This is a voluntary service: it does not condition the publication of the advertisement or its visibility.

The verification photograph is never published under any circumstances. It is stored in a directory that is not publicly accessible, its metadata is stripped, it is accessible only to authorised moderation staff, and it is deleted once the check has been resolved, only the result and its date being retained. The details are set out in the Privacy Policy.

The badge is tied to the specific photograph that was checked and is revoked automatically if that photograph is removed from the advertisement.

6.5. Duration and expiry

Advertisements remain published for as long as the account is active and the Advertiser does not delete or hide them. Contracted visibility services last for the period indicated at the time of purchase.

In order to maintain the quality of the directory, advertisements that remain without any activity by their owner for two months are automatically unpublished. The Advertiser receives advance notices by email and may reactivate the advertisement at any time by logging into their account. Likewise we reserved the right to delete any ad that does not fulfill the minimum requirements of quality. With the same purpose, we reserved the right to restrict the publishing of an ad for any reason.

7. Contact details and protection against mass extraction

Published contact details are displayed by means of a reveal-on-demand mechanism. Its sole purpose is to allow an interested Visitor to contact the Advertiser.

The mass or systematic collection, extraction, storage or reuse of that data by any means, automated or manual, is prohibited. AngelsDeluxe applies per-requester usage limits and logs the reveals served for security and abuse-prevention purposes, in accordance with the Privacy Policy.

8. User obligations

In addition to the above, the user undertakes not to:

• Use the Website for unlawful purposes or purposes contrary to these Terms, good faith or public policy.
• Publish the same advertisement more than once, or in categories or locations that do not correspond to its actual content.
• Impersonate another person or use another person’s data, images or telephone numbers.
• Harass, threaten, intimidate or abuse other users.
• Use robots, spiders, scrapers or any automated means to access the Website or extract content.
• Interfere with the operation of the Website, overload it or introduce malicious code.
• Circumvent or attempt to circumvent the security, verification, moderation or usage-limitation measures.
• Abuse the reporting system.
• Send unsolicited commercial communications to other users.

9. Paid services

9.1. Services and prices

Creating an account and publishing an advertisement in its basic form are free of charge.

Optionally, the Advertiser may contract visibility services — featured tiers and automatic bumps of the advertisement — which place their profile in preferential positions in the listing for the period contracted.

The prices in force, inclusive of applicable taxes, are shown in the Payments section of the Advertiser’s account before any purchase is confirmed. AngelsDeluxe may change its prices at any time; new prices apply only to purchases made after their publication and never to services already paid for.

Contracted services do not renew automatically. At the end of the period the advertisement returns to its basic form and the Advertiser may purchase again whenever they wish.

9.2. Payment methods

Payment is made using the methods enabled from time to time in the Payments section, currently bank transfer and Bizum. Once receipt of payment is confirmed, the service is activated on the advertisement indicated.

It is essential to include the advertisement code provided with the request as the payment reference, since this is what allows the payment to be identified and applied to the correct profile. AngelsDeluxe is not liable for delays arising from payments that cannot be identified.

AngelsDeluxe does not store payment card data.

9.3. No right of withdrawal

Visibility services are contracted between businesses or professionals: AngelsDeluxe provides them in the exercise of its activity and the Advertiser contracts them within the framework of theirs, as declared on registration (clause 4).

Consequently, the right of withdrawal is not applicable — the right provided for in Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, the scope of which is confined to consumer relationships.

In addition, visibility services are digital services performed immediately: once payment is confirmed, the advertisement takes up the position contracted and begins to receive visibility, which constitutes full performance of the service. Once the advertisement has been disseminated among the Website’s visitors, performance is irreversible by its very nature, and it is not possible to restore it or undo the dissemination that has already taken place.

For all these reasons, the Advertiser has no legal right of withdrawal in respect of the visibility services contracted.

Notwithstanding the foregoing, and on a voluntary basis, AngelsDeluxe offers the refund policy set out in clause 9.4, which is granted as a commercial concession and not as recognition of any legal right.

9.4. Refund policy

Although there is no legal obligation to do so, AngelsDeluxe takes the view that an Advertiser should be able to reverse a purchase made in error or immediately regretted. Accordingly:

You have twenty-four (24) hours from activation of the service to request its cancellation and a full refund of the amount paid, with no need to give any reason.

On cancellation, the visibility service ceases to apply to the advertisement, which returns to its basic form. The advertisement itself remains published.

Once those 24 hours have elapsed, and given that the service is already being performed and its dissemination cannot be undone, no refund of the amount corresponding to the service contracted will be due, without prejudice to the cases set out in clause 9.5.

To request a refund, write to info@angelsdeluxe.com stating the advertisement code and the date of purchase. The refund will be made using the same means of payment used.

This policy does not apply where the advertisement or the account has been withdrawn or blocked for breach of these Terms, in particular for infringement of clauses 3.2, 3.3 or 3.4, for fraud, for impersonation, or for refusal to evidence age of majority. Nor does it apply where abusive or repeated use is made of the refund policy itself.

9.5. Breach by AngelsDeluxe

Irrespective of the period above, and at any time, a refund — full or proportionate as appropriate — will be due where the service has not been provided correctly for reasons attributable to AngelsDeluxe. Specifically, where:

• The service contracted fails to activate for reasons attributable to AngelsDeluxe.
• The service is interrupted for a prolonged period by a technical incident attributable to AngelsDeluxe, in which case the proportionate part not enjoyed will be refunded or compensated by extending the duration of the service.
• A duplicate or erroneous charge occurs.
• The advertisement is withdrawn as a result of a moderation decision that is subsequently reversed on appeal in accordance with clause 10.4.

To request this, simply write to info@angelsdeluxe.com stating the advertisement code, the date of purchase and proof of payment. The refund will be made using the same means of payment used, within a maximum of fourteen calendar days from confirmation that it is due.

9.6. Invoicing

The Advertiser receives the details of each service contracted by email.

As the services are contracted between professionals, AngelsDeluxe will issue the corresponding invoice. For this purpose the Advertiser must provide their full tax details — name or company name, tax ID (NIF/CIF) and tax address — by sending them to info@angelsdeluxe.com, and undertakes to notify any change to them. AngelsDeluxe is not liable for the consequences of a failure to provide those details or of their inaccuracy.

10. Moderation, reports and complaints

10.1. Reporting content

Any person may notify AngelsDeluxe of the existence of content they consider unlawful or contrary to these Terms, by means of the report button available on every profile or by writing to info@angelsdeluxe.com.

To enable the report to be processed, it is helpful to state: the public code or address of the profile, a description of the reason, and, if the complainant so wishes, a means of contact for a reply.

10.2. Processing and time limits

Every report is reviewed diligently. The target time for resolution is seven (7) working days from receipt; cases affecting the safety of individuals are dealt with as a priority and immediately.

If it is concluded that the content infringes the law or these Terms, it will be removed or access to it blocked and, depending on the seriousness, measures will be taken in respect of the account responsible.

10.3. Statement of reasons for decisions

Where AngelsDeluxe removes content, refuses its publication or suspends an account, it will inform the person affected of the decision and the reasons for it by email, stating the clause or rule infringed and the avenues of appeal available.

10.4. Right of appeal

An Advertiser affected by a moderation decision may appeal against it by writing to info@angelsdeluxe.com within six months of being notified of it, setting out the reasons why they consider the decision to have been incorrect. The appeal will be examined by a person other than the one who took the initial decision and will be decided with reasons given.

If, following that examination, it is concluded that the decision was wrong, the content or account will be restored and, where appropriate, the period of service not enjoyed will be compensated.

10.5. Rights of persons appearing in an advertisement

Any person appearing in an image or video published on the Website may request its immediate removal, irrespective of who published it, by writing to info@angelsdeluxe.com. Such requests are dealt with as a priority.

10.6. Criminal offences and reporting to the authorities

AngelsDeluxe maintains a zero-tolerance policy towards child sexual abuse material, human trafficking, procuring, forced labour and any other form of exploitation or coercion.

Where AngelsDeluxe becomes aware of facts that may constitute a criminal offence, it will remove the content, preserve any information that may be necessary and bring the matter to the attention of the competent authorities, cooperating with them as required.

If you suspect that a person advertised on AngelsDeluxe may be being coerced, controlled by third parties, or may be a victim of trafficking or exploitation, report it immediately to info@angelsdeluxe.com or by means of the report button. Such reports are treated as an absolute priority and may be made anonymously.

AngelsDeluxe will provide the State Law Enforcement Agencies and the judicial authority, through the legally established channels, with such information as it holds — including connection logs and technical data — as may be necessary for the investigation and prosecution of these offences.

Breach of the provisions of this clause and of clause 3.4 results in permanent blocking of access to the Website, irrespective of any payment made, and in the corresponding report to the authorities.

11. Suspension and cancellation

AngelsDeluxe may withdraw an advertisement, or suspend or cancel an account, where:

• These Terms are breached, in particular the content policy in clause 3.
• There are reasonable indications of fraud, impersonation, extortion or unlawful activity.
• The user refuses to evidence their age of majority or identity when required to do so.
• A legal obligation or a decision of a competent authority requires it.

Except in serious or urgent cases, AngelsDeluxe will warn the user beforehand and indicate how to remedy the matter. Repetition after a warning will result in the account being blocked.

Every measure is notified with reasons given and may be appealed in accordance with clause 10.4.

12. User content and licence of use

The Advertiser retains ownership of the texts, photographs and videos they publish.

In publishing them, they grant AngelsDeluxe a non-exclusive, royalty-free licence limited to the territory in which the service is provided, to reproduce, store, technically adapt, translate and publicly communicate that content, for the sole purpose of operating and displaying the Website. This licence expressly includes:

• The generation of optimised versions and different sizes of the images, and the technical processing of the videos for playback.
• The machine translation of the advertisement’s title and description into the languages in which the Website is offered.
• The display of the content on the listing pages, profile page and video sections of the Website.

The licence terminates when the Advertiser deletes the content or their account, without prejudice to any copies that must be retained by legal obligation or to address liabilities, and to the fact that the content may remain temporarily in third-party caches or search engine results until they are updated, a circumstance beyond AngelsDeluxe’s control.

AngelsDeluxe does not transfer or license Advertisers’ content to third parties for advertising or commercial exploitation.

The Advertiser warrants that they hold all necessary rights over the content they publish and that its publication does not infringe the rights of third parties, and shall indemnify AngelsDeluxe against any claim arising from a breach of this warranty.

13. Availability and liability

AngelsDeluxe uses reasonable means to keep the Website available and secure, but does not warrant uninterrupted or error-free operation.

AngelsDeluxe is not liable for the relationships that users establish between themselves, or for the truthfulness of the content published by Advertisers, without prejudice to the prior moderation it carries out and to its obligation to remove diligently any unlawful content of which it has actual knowledge.

13.1. Limitation of liability towards the Advertiser

As the services are contracted between professionals, and to the extent permitted by applicable law, AngelsDeluxe’s total aggregate liability towards the Advertiser for any claim arising from these Terms or from the provision of the visibility services shall be limited to the greater of the following amounts:

1. The total amount actually paid by the Advertiser to AngelsDeluxe during the twelve (12) months preceding the event giving rise to the liability; or
2. One hundred euros (€100).

Liability for indirect damage, loss of profit, loss of business opportunity, loss of data or reputational harm is excluded in all cases.

13.2. Carve-outs

The limitations in clause 13.1 shall not apply and do not in any way limit or exclude AngelsDeluxe’s liability:

• For wilful misconduct (dolo), the exclusion of which is void under article 1102 of the Spanish Civil Code, or for gross negligence.
• For personal injury caused by its conduct.
• In any other case in which applicable law does not permit its limitation or exclusion.
• Towards users who access the Website and have the status of consumer, in respect of whom only the legal regime applicable to them shall govern.

Likewise, these limitations do not affect the refunds provided for in clauses 9.4 and 9.5, which are governed by the provisions set out there.

14. Deleted advertisements and search engines

When you delete your advertisement or your account, the content immediately ceases to be available on AngelsDeluxe. However, search engines (Google, Bing and others) maintain their own indexes and cached copies, updated according to their own processes, entirely beyond AngelsDeluxe’s control. As a result, an advertisement that has already been deleted may continue to appear temporarily in their results.

You can request removal directly from each search engine through their outdated-content removal tools. AngelsDeluxe will cooperate by providing such information as may be necessary to evidence that the content no longer exists.

15. Safety recommendations

AngelsDeluxe advises all users to take the greatest care in their contacts: do not make payments in advance, do not give out your home address or unnecessary personal data, be wary of anyone who asks for money on any pretext, and report any attempted extortion or fraud both to AngelsDeluxe and to the authorities.

16. Data protection

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

17. Amendment of the Terms

AngelsDeluxe may amend these Terms to reflect legal, technical or service changes. The version in force will always be the one published on this page, stating its update date.

Where the amendment is substantial and affects Advertisers with services in force, it will be notified by email with reasonable advance notice. Use of the Website after the amendment takes effect implies acceptance of the new version.

18. Partial invalidity

If any clause is declared void or unenforceable, that declaration shall not affect the validity of the remainder of the Terms, which shall continue in full force and effect.

19. Applicable law and jurisdiction

These Terms are governed by Spanish law.

As the services are contracted between professionals, for any dispute arising from the relationship between AngelsDeluxe and the Advertiser both parties expressly submit, waiving any other forum to which they may be entitled, to the Courts and Tribunals of [[CIUDAD DEL DOMICILIO SOCIAL]].

The foregoing does not affect the rights of those who access the Website as users and have the status of consumer under applicable law, who may bring proceedings before the courts determined in each case by consumer protection legislation.

Before taking legal action, AngelsDeluxe makes the address info@angelsdeluxe.com available to any user with a view to resolving any complaint amicably.

20. Language and authentic version

These Terms of Use have been drawn up in Spanish. The English version is a courtesy translation, provided solely to make the content accessible to English-speaking users.

In the event of any discrepancy, contradiction or difference of interpretation between the two versions, the Spanish version shall prevail, and it alone shall be regarded as the authentic text for all legal purposes. This applies in particular to the interpretive clause in section 3.1, whose Spanish wording governs.
